OVERVIEW Welcome to Truck Guy Upfitters! The terms "we", "us", and "our" refer to Truck Guy Upfitters (and whatever coffee is currently fueling us). We operate this store and website—including all features, content, gear, and tools—to provide you with a curated shopping experience (the "Services"). We’re powered by Shopify, which means they provide the backend tech that lets us sell you cool stuff.

The terms and conditions below, along with any policies linked here (these "Terms of Service" or "Terms"), outline your rights and responsibilities. Please read them. Yes, actually read them—or at least skim enough to know what you’re agreeing to, because these terms cover legal rights, warranty disclaimers, and limitations of liability.

You are entirely responsible for keeping your login credentials secure and for everything that happens under your account. You cannot sell, trade, or give your account to your buddy down the street.

Product descriptions and pricing can change at any time without notice. We reserve the right to discontinue any item whenever we want, or limit sale quantities on a case-by-case basis depending on supply, geography, or jurisdiction.

SECTION 3 - ORDERS

When you press "Place Order," you are making an offer to buy. We reserve the right to accept or decline that offer for any reason at our discretion. Your order isn't officially accepted until we process your payment and confirm it.

Please double-check your cart before clicking buy; once an order hits our system, we might not be able to cancel it. If we cancel, modify, or reject an order, we’ll try to let you know via the email, billing address, or phone number you gave us.

Returns and exchanges are governed strictly by our Refund Policy [LINK]. Also, you confirm you are buying gear for your own personal or household use—not for commercial resale, export, or shady grey-market operation.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promos can change without notice. You pay the price listed at the exact moment your order goes through, as shown in your confirmation email. Unless explicitly stated, posted prices do not include taxes, shipping, customs, or import fees.

Prices on our site might differ from physical stores or third-party sellers. If we run a special promo, separate promotional terms might apply; if those terms conflict with these Terms, the promo terms win.

You agree to keep your billing info accurate and updated. You represent and warrant that: (i) your payment info is valid and truthful, (ii) you are authorized to use that credit card, (iii) your card company will actually pay us, and (iv) you will cover all posted charges, shipping, and taxes.

SECTION 5 - SHIPPING AND DELIVERY

Once we hand your package off to the carrier, risk of loss and title pass to you. Delivery times are estimates, not blood oaths. We are not liable for shipping delays caused by carriers, weather, customs, national holidays, or random acts of chaos outside our control.

SECTION 6 - INTELLECTUAL PROPERTY

Everything on this site—logos, designs, text, graphics, photos, video, audio, layout, and brand assets—is owned by Truck Guy Upfitters, its affiliates, or licensors, and is protected by intellectual property laws.

You get permission to use this site for personal, non-commercial use only. You cannot copy, modify, distribute, scrape, republish, or steal our content without explicit written consent.

"Truck Guy Upfitters," our logos, and slogans belong to us. "Shopify" belongs to Shopify. Other brand names belong to their respective owners. Don't use them without permission.

We might give you access to third-party tools or integrations that we don't control, monitor, or manage.

We provide access to these tools "as is" and "as available," without any warranties, endorsements, or guarantees. Use them entirely at your own risk. If a third-party tool acts up, take it up with the provider, not us.

Truck Guy Upfitters is powered by Shopify. Shopify provides the e-commerce platform, but your actual transaction is strictly with Truck Guy Upfitters.

By using this site, you acknowledge that Shopify is not responsible for any sales, product issues, injuries, or losses resulting from purchases made here. You expressly release Shopify and its affiliates from any claims arising out of your transactions with us.

Human error happens. Occasionally, product listings, pricing, promotions, shipping costs, or stock levels might contain typos or mistakes. We reserve the right to correct errors, update info, or cancel orders affected by inaccuracies at any time without prior notice—even after you've submitted your order.

We reserve the right to block your access or ban your account instantly if you breach these rules.

SECTION 14 - AI AGENTS & AUTOMATED BOT TERMS

14.1 This section applies if you use, deploy, or allow any software "Agent" (autonomous or semi-autonomous scripts, bots, or AI services) to interact with our site without direct human supervision. 14.2 Bots and AI Agents are strictly prohibited from accessing our store unless they identify themselves clearly and follow section 14.4. If we tell your bot to scram, it must scram. 14.3 We reserve the right to block, throttle, or technically restrict any Agent at our discretion. 14.4 Any permitted Agent MUST:

  • Include "Agent/[agent name]" in its HTTP User-Agent request header;

  • Never disguise its automated nature, mimic human click patterns, or solve CAPTCHAs fraudulently;

  • Truthfully answer any prompt asking if it is a human or a computer;

  • Respect robot exclusion headers and security parameters.

SECTION 15 - TERMINATION

We can terminate this agreement or block your access to our store at any time, without notice, if you breach these terms (and you'll still owe us for any pending orders/balances up to that date).

Sections covering Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Severability will survive termination.

SECTION 16 - DISCLAIMER OF WARRANTIES

We provide the site and products "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, we make zero warranties or guarantees—express or implied—including implied warranties of merchantability, fitness for a particular purpose, durability, or non-infringement.

We don't guarantee that your use of the site will be completely uninterrupted, perfectly secure, or 100% error-free. Some legal jurisdictions don't allow limitations on implied warranties, so some of this disclaimer might not apply to you.

SECTION 17 - LIMITATION OF LIABILITY

To the fullest extent allowed by law, Truck Guy Upfitters, our directors, officers, employees, affiliates, agents, contractors, and suppliers (plus Shopify and its team) shall NOT be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind.

This includes lost profits, lost revenue, lost savings, lost data, replacement costs, or similar damages—whether based in contract, tort (including negligence), or strict liability—arising from your use of our site or any products purchased here. Even if we were warned that damage was possible.

SECTION 18 - INDEMNIFICATION

If you mess up, break the law, violate these Terms, or infringe on someone else's rights, and someone sues us or Shopify because of it, you agree to step up and defend us.

You agree to pay our legal costs, liabilities, damages, and reasonable attorney fees arising out of your actions. We reserve the right to control the legal defense at your expense, and you agree to cooperate fully with our legal counsel.

SECTION 19 - SEVERABILITY

If a court decides that any specific provision in these Terms is illegal, void, or unenforceable, that specific part will be chopped out (severed), but the rest of the Terms remain 100% valid and enforceable.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

If we fail to enforce a specific rule once, that doesn't mean we waive our right to enforce it later.

These Terms (and linked policies) constitute the ENTIRE agreement between you and Truck Guy Upfitters regarding your use of our Services, wiping out any prior chats, emails, or old versions of the Terms. Any vagueness in these Terms won't be held against us just because we wrote them.

SECTION 21 - ASSIGNMENT

You cannot transfer, delegate, or assign your rights or duties under these Terms to anyone else. We can assign or transfer our rights and obligations under this agreement whenever we want, without asking for your permission.

These Terms of Service and any purchases made here shall be governed by and construed in accordance with the laws of the jurisdiction where Truck Guy Upfitters is headquartered. You consent to the exclusive personal jurisdiction and venue of the federal and state courts located in our home jurisdiction.
